The High Judicial and Prosecutorial Council of Bosnia and Herzegovina (hereinafter: the Council) is competent (Article 17 of the Law on the HJPC BiH) to receive complaints against judges and prosecutors, conduct disciplinary proceedings, determine disciplinary liability, and impose disciplinary measures on judges, lay judges, reserve judges, and prosecutors.
The Office of the Disciplinary Counsel (hereinafter: the Office) performs the role of a prosecutor (Article 64 of the Law on the HJPC BiH) in relation to allegations concerning breaches of duty by judges or prosecutors. The Office is responsible for assessing the legal merit of complaints, investigating allegations of breaches of duty by judges or prosecutors, initiating disciplinary proceedings, and representing cases of disciplinary offences before the Council’s disciplinary panels. The Office may initiate investigations on its own initiative or on the basis of a complaint, which may be submitted by any person, institution, or organization. Complaints must be submitted to the Office of the Disciplinary Counsel in written form, accompanied by evidence supporting the allegations (Article 81 of the HJPC Rules of Procedure). The requirement for written form is also met if the complaint is submitted via e-mail.

As explained in detail in the published by the Office, once a complaint is received, it is entered into the complaints register, followed by a preliminary review of the allegations and a decision on whether to initiate an investigation or dismiss the complaint (Articles 82 and 83, paragraph 1 of the HJPC Rules of Procedure). The Office will dismiss a complaint in the following cases: if the complaint falls outside the competence of the Council; if the complaint does not relate to conduct or actions constituting a disciplinary offence; if the alleged breach of duty is minor; if the statute of limitations for initiating or conducting disciplinary proceedings has expired; if the complaint is submitted with the purpose of exerting improper influence on proceedings pending before a court or prosecutor’s office; if the complaint is unintelligible; if a decision has already been rendered in the same matter. In cases where an investigation is conducted, upon its conclusion the Office will make a final decision, based on the evidence provided by the complainant and other collected evidence, as to whether the established facts justify initiating disciplinary proceedings before the Council.
